2008 Election Lawsuit series
PR3809.0002 · Series · 2008-2012
Part of Kevin Taft fonds

The series consists of the records created and maintained by Grant Dunlop and the law office of Ogilvie LLP for the purpose of the legal trial of Kevin Taft versus the Crown between 2008 and 2012. Records include email communications sent and received by Dunlop concerning the case; transcripts of witness interrogations and cross-examinations; and documents prepared for the trial such as authorities and precedents, factums, affidavits, evidence extracts and statutes.

In 2008, M.L.A. Kevin Taft contracted Grant Dunlop and the legal team of Ogilvie LLP to pursue legal action against the Crown over the conduct of the 2008 Alberta provincial general election. On behalf of Kevin Taft and the citizens of Alberta, Dunlop’s team sought litigation against the Province of Alberta for denying them the right to play a meaningful role in the 2008 provincial general election.

Charges included biased hiring practices enacted by the Chief Electoral Officer; failure to locate polling places on First Nations reserves, assisted care facilities and rural areas; failure to issue special ballot requests; failure to communicate polling location changes to all political party candidates in an electoral district; directing certain eligible voters to the wrong polling places; and last-minute appointment of electoral officers causing electoral subdivisions to be redrawn, resulting in inaccuracies in voter lists and long wait times on election day.
