    Administrative history

Although staff within the Ministry of the Attorney General had performed the function of drafting legislation since 1905, a separate Office of the Legislative Counsel was not established until 1921 (SA 1921, c. 5, s. 36(3)). The position originated from the Revised Statutes Act of 1919 (S.A. 1919, c. 5), with one of the commissioners appointed under that act continuing in the role of Legislative Counsel.

The Legislative Counsel was responsible for providing advice on the revision and consolidation of legislation as well as the drafting of regulations and orders-in-council. The position continued after the legislative mandate was removed in 1969 (SA 1969, c. 60, s. 3). The Office was transferred to the Ministry of Justice in 1992.
